I'm not familiar with the history of their legal battles, but has Konami ever explicitly lost on one of their filed claims pertaining to patent defense?

Well, it happened. YouTubeYouTube is facing a $1 billion+ lawsuit from Viacom today. It was known that YouTube would eventually face at least one major lawsuit, and Viacom - which had already pulled 100,000 clips from the site, was perhaps the most likely to take a distaste to the company.
Viacom is accusing YouTube of “massive intentional copyright infringement”, saying that 160,000 unauthorized Viacom clips have been uploaded onto YouTube, totaling more than 1.5 billion views. In truth, the “more than $1 billion” figure sounds a little low: typically these companies seek the maximum sum of $150,000 per infringement. This was the case with Bolt.com, which decided to settle for $10 million rather than endure a lengthy legal battle against Universal.
Viacom, owner of MTV and Nickelodeon, put out a release regarding the YouTube case today, with the following statement:
There is no question that YouTube and Google are continuing to take the fruit of our efforts without permission and destroying enormous value in the process. This is value that rightfully belongs to the writers, directors and talent who create it and companies like Viacom that have invested to make possible this innovation and creativity.
So this is the ultimate showdown: a test whether you can “pull a YouTube” and get away with it. YouTube, frankly, has moved the video market forward faster than any other player, and that high risk game is ultimately good for users. If it had been left to Viacom and its ilk to move forward with Internet TV, we’d still be watching everything in Windows Media or Realplayer format, with no progress made over the past two years. These companies didn’t innovate, and suddenly found themselves contending with a young upstart that was driving more viewers to their content than they ever could. Fearing loss of control, particularly of the distribution channel, suing seemed like the best option for a company that’s anti-innovation. That said, YouTube was also so incredibly slow to roll out its copy protection, and only delivered a deal with AudibleMagic when we expected an in-house solution, that it gave these lawsuits the opportunity to bubble up.

Viacom is a **** and a half anyway. Their marketing techniques are fowl and they would try to sell herpes to the crowd if it would make them a quick buck or two.
I mean, f**k.. They purposely popularisedgangsta rap with the sole intent on getting kids from the ghettos to look up on that sort of lifestyle so they would be more inclined to buy their merchandise.
Im sure Viacom conveniently forgot about the "bustin a cap in yo ass" part to that lifestyle...
...but this is why I couldnt give a flying **** in the first place.Comment

It's a bit unfair for Konami to just try to shoot something down that was really innovative--it's something new that Konami didn't even think of. Now that someone beat them to the punch, they want to take advantage of it. Typical of Konami nowadays.
Pretty soon, someone other than Konami will make a game that is similar, yet better than Yu-Gi-Oh, and Konami will just go sue-happy on them too.

Basically... because they DID come up with the original ideas for these games and did create the original hardware for these. You'll notice that all of their major lawsuits have revolved around the hardware, not the games themselves.... MUCH easier to prove the hardware patents (especially in the Roxor case, when they were literally using DDR machines). AFAIK, they've never lost one of their lawsuits.
But in a world of patents and intellectual property, if it not unfair of MTV to have not given royalties to Konami from the start, as they hold the patents on these types of things? It would have saved them bad press and likely money too... this will be a lengthy and costly legal battle. But, think of it this way. Saying that any music and rythm game is like DDR is like saying every RPG is like Zelda.
By that i mean you run around, fight stuff, collect stuf and blah blah. Yet theres no way Nintendo could sue Sony for GTA, although it is the same concept, just wiht defferent weapons, essentialy.
So if we go by what Konami says then then not only is GTA the same exact thing as The Legend of Zelda, the mic in Rock Band is the same as DDR because you have to hit things in time with music, correct?

By the way OH WHY AREN'T THEY GOING AFTER ACTIVISION

Why is it just Rock Band? Because Harmonix doesn't know the law and when they broke with Activision, they lost their usage rights to the patent and had to re-file for its use. They didn't. This is Harmonix not jumping through the correct legal hoops, and Konami handing them their ass because of it.
ITG vs. DDR was a whole nother case entirely... I knew the person who was head of the firm that investigated whether or not consumers could tell the difference between ITG machines and DDR machines. The process for that case was a lot more complex because there were legitimate points of comparison between the products.Comment

From the looks of it, Harmonix only patented the guitar itself, while Konami patented the concept of having a music game wherein you match symbols to buttons on a controller in time with the music.

Konami is just crap. They can't take the heat, so they have to sue to make their penises feel bigger. They know that they stand no chance against these companies when it comes to making music games, because they have retards working the machines. Once they know they are going to have their crap games stomped on, they have to sue to make sure they stay on top so people will be forced to buy crap games since everything else that's good has been terminated.
If you're the only company on the market, then you have absolutely no competition.Comment
