Also, unless the two computers involved belonged to the two kids, someone else was technically in possession of the pictures the instant the e-mail was opened.

Laws regarding child pornography should never be put in place which would end up punishing the child, regardless of situation.

As for letting people do what they want in private, yes, I agree, but between consenting adults.

They'll think it's just fine when it's clearly not (not in all cases, mind you, blahbidy blah). In Texas, at least, so long as the guy isn't above 17 or 18 or whatever the statutory limit is, it's okay for them to have sex. That is, so long as one's not old enough to be considered predatory, there's no crime of rape there.

Hell, the very thought of a sixteen year old being mature enough when it comes to sex is laughable. The age where you become an adult is set at eighteen for a good reason. If you're under that, you're considered a child...for good reason.

They weren't consenting adults by any stretch of the imagination. They probably consented, but hey, since they weren't adults, their consent is to be taken with a grain of salt.

I see no problem whatsoever so long as BOTH parties are underage...to a point. Two nine-year-olds having sex obviously isn't right IMO...I don't see a problem with having a middle groud for teens, though. They have some maturity, just not a ton of it.

If no one saw the photo, why would they get punished? Why would it occur to the law to punish them?

As long as you can keep something completely under wraps you're not going to get in trouble for it. Clearly someone other than those involved saw the photo, which is why law enforcement stepped it.

You're not going to get an answer to "But why?" here because none of us are qualified to answer your question, let alone are in any sort of position to change the rules. I suggest writing your local congressman or police chief if you really want to know why these things happen.

They are putting stuff in food and water to make 12 yr olds = 18 yr old looking nowadays. So maturity get's all messed up in the process. How the hell is some 14 yr old kid supposed to make a rational decision when his 13 yr old gf is bouncing her C cups in his face?

Mind you, the 13 yr old girl is probably all confused too. She's probably thinking "I'm 13, wtf. I should be playing with barbie dolls but now I can no longer look down and see my feet because of these huge things... oh well, this boy said he likes him. I'll take it."

So yeah, there you have it, rationale is now thrown out the window. Using laws from umpteen years ago for today's youth no longer applies. We need to rewrite some laws. We should also add a few in there about emo stuff too.

Around 12, hormones really do start blahblahblahing (mental block), and most 13 year olds would not play with child toys. Around 13, you're no longer a child, but you're definitely not an adult either.

In ancient times, humans had shorter life spans due to less attempts at prolonging life. I believe people married around 14-16. It just happened that evolution has not and probably will not catch up with society's expectations.

Um, of course. What else would we be discussing in this topic? Whether or not it was actually illegal or not? Obviously it was, or else there wouldn't have been any problem. I thought the whole POINT was a discussion of the legitimacy, or lackthereof, of the details of the law that caused this situation.
