Re: Teens charged for possession of child porn... of themselves...
UhWhat do you mean what's wrong with the government? That's child pornography, no matter who took the pictures. And even though they weren't going around showing all their friends, the pictures were still distributed (even if just to each other, via email) and other people found out about them.
It's child porn, something pedophiles drool over.
There is some murky water here, I realize, what with doing things in your own home and whatnot, but there's really not enough information here to just blow off what the police are doing as idiotic.
Yeah there is. The entire function of making child pornography illegal is to protect the minor who would have been photographed. If the minor is photographing themselves, no one else is harming them. It really is the same as saying that masturbation is the same as molestation.
The fact of the matter is that, yes, if those images found their way into a cp ring they'd probably get some attention (as others have said, pedophiles generally aren't interested in someone that old), but that's when illegality of it should come into play. It shouldn't be illegal for a minor to photograph themselves, but it is illegal for someone else to have them. I know this comes back to the fact that they shared photographs with each other, but would you charge a 17 year old with statutory rape if they had sex with a 16 year old (assuming age of consent is 18 where they are)? That would be completely ****ed up.
ps some of you are forgetting that nude photos of children aren't automatically child pornography. As long as the photo is not sexual in nature (ie a photo of a child in a bathtub playing with bubbles), it is not cp, even if the photo shows the child's entire body.
EDIT: by the way, if nude tub photos were cp, it'd be the one who took the photograph going to jail... not the child. Imagine if they put kids in jail who had been kidnapped and molested and photographed. ****ed up.

Re: Teens charged for possession of child porn... of themselves...
I have to agree with Afrobean, even though it is technically child porn, the children shouldn't be arrested for having the pictures, because they took them themselves and were consenting. A lot different then a pedophile kidnapping a 16 year old and taking pictures of him/her.Comment

Re: Teens charged for possession of child porn... of themselves...
I think it's alright, as long as you view it. It's stupid to go to jail for something like that, since they only showed 1 person, they didn't post anything over the internet. It's yourself, and they are gonna put you in jail for taking pictures of yourself then looking at it?What do you mean what's wrong with the government? Like, cmon. That's the stupidest law ever. It may be child porn, but who else will be viewing it? It said they didn't post it over the internet, they just send it to theri friend, Jeremy.
I think they should have a right to those pictures. As sick as it may be, what harm can it cause? Not that I support child porn, that is. But I believe in rights.

Re: Teens charged for possession of child porn... of themselves...
There's a LOOOOOOT of gray area here. I personally believe that if you're 15+ you should be able to make your own decisions when it comes to these kinds of things, but the law apparently doesn't think so. I think what the court was thinking, was probably more along the lines of "We don't know if they're distributing it" because if let's say they were selling the photos then it would be child pornography, because they are minors and it would be porn. However, there's no proof of distribution. I have some "risque" pictures of my girlfriend and such, but I'm the only one with any (I hope...Lots of bad experiences lol). You can look at it from both points of view. I think it was a bogus charge, but how do the cops get the lead that these kids have the photos? I mean really, it's not like cops do random e-mail searches. Someone tipped someone off or SOMETHING. That's what makes it hard to believe these kids weren't distributing in some way.
...None of this post seems to make sense, but, yea lol. Lots of gray area.Comment

Re: Teens charged for possession of child porn... of themselves...
Actually I recall a story about some kids in Georgia or Alabama or some other state where two consenting seventeen-year-olds were charged with statutory rape (of each other) because they were under the age of consent in their state.
Bizarre **** like this happens all the time, guys.
This is probably actually an issue of someone's mom finding the pictures and calling the cops like that woman who had her 12-year-old arrested for opening a Christmas present early.Comment

In addition, the statute was intended to protect minors like appellant and her co-defendant from their own lack of judgment...
Hopefully this case will teach kids not to be ****ing morons.I watched clouds awobbly from the floor o' that kayak. Souls cross ages like clouds cross skies, an' tho' a cloud's shape nor hue nor size don't stay the same, it's still a cloud an' so is a soul. Who can say where the cloud's blowed from or who the soul'll be 'morrow? Only Sonmi the east an' the west an' the compass an' the atlas, yay, only the atlas o' clouds.Comment
