I thought the same thing, and the song usage is quite similar to FFR overall.
It violates most licenses that these songs have because the game is $50. Making a profit off of content that was otherwise created for free use violates a lot of rights.
Exactly as Staiain said, their UI was based off of Stepmania, but it was in fact a re-code. Artists gave Roxor consent for song licensing, and whatnot. A lot of people misunderstand the reason why Roxor got sued in the first place - it involved upgrading cabinets, not just the premise of ITG itself. In this instance, you have created content (charts) that other people have made and never spoken to the person(s) responsible for this content, and you have artists who don't have proper licensing.

Just adding, I believe that those in development of ITG had permission to work on the Stepmania source code and use it for their own game. The problem with the lawsuit isn't only the fact that it's a "4-panel dance game" (that apparently Koname had rights to), but the fact that ITG had the upgrade kits where they could install ITG into DDR cabinets. Of course, taking something from DDR was a big no-no
I'm sure the "custom songs" thing was also another big issue in it, but not as much.
In all technicality, there's nothing stopping people from taking SM's source itself and using it like this because the entire project is open source. The biggest offender is the content.
