The reason it doesn't infringe it is because the spammers have freedom of expression, if they think that advertising their stuff is OK then they are expressing.
On the other hand, this guy lost that privilage because he made a direct THREAT. Thus the material being unprotected by the constitution, so he can be arrested. Not to mention pornography is also unprotected by the constitution. Meaning you can't barge into one of your nearby cities swearing madly and carrying a banner with goatse on it. Don't get any ideas moogy.
