According to the definition of Open Source you should be good to go.

Also uploaders select which Creative Commons License they wish to use so check here if you are able to step it:

Then again for a big site like this people can upload fake or stolen content so be careful.

archive.org seems like its a great place that has a bunch of awesome music on it. all of it seems to be CC from what ive checked out

Just because anyone could post a link and just say they got permission from that artist when they probably didnt.

Well, you could help translate permissions, and I'm sure you'd be responsible enough to get them anyway. The point of it is so verify that permissions are actually obtained, not via hear-say, but also through documented proof.
