a little bit of a legal questions

I've been making a stepfile for a song called "Ride on Shooting Star." For those of you who don't know, it's the ending theme for FLCL and is copyrighted. Now for my question: Is it legal for me to make this file for myself? Also is it legal to make it for distribution? Of course, for distribution, the mp3 would be omitted for obvious legal reasons.

        The hell dude.

People dwi' copyrighted music all the time.

        Nobody cares.

Like if you want to get down and dirty, SM itself probably isn't even legal. So don't even worry about it

I DWIed ROSS a long time ago.

So did several other people, but mine was the best because it was mine. Well, after I fixed the BPM. :O
I watched clouds awobbly from the floor o' that kayak. Souls cross ages like clouds cross skies, an' tho' a cloud's shape nor hue nor size don't stay the same, it's still a cloud an' so is a soul. Who can say where the cloud's blowed from or who the soul'll be 'morrow? Only Sonmi the east an' the west an' the compass an' the atlas, yay, only the atlas o' clouds.

While, I don't have legal training, I can at least make a provocative argument:

The .dwi and .sm files are merely text files that you more or less make yourself (considering an editor to be your tool in creating it)

As such, they are basically your intellectual property, although unprotected, and probably not covered under FLCL's copyrights or whatnot.

Distributing without the mp3 is most likely legal, but you also run the risk of the people who download your stepfile not having the mp3, or even the same mp3 of the song (even tiny changes would throw a stepfile off completely).

That said, I do enjoy making stepfiles of copyrighted songs that I keep for myself: "Cruel Angel's Thesis", theme from "Neon Genesis Evangelion"... I'd love to see your finished file for the FLCL theme!

I'd like to know if I can upload .dwi and image files in a zip archive to the FFR simfile section, then tell people that if they want to play the song they just have to download the song elsewhere? I have a few copyrighted songs that I've made simfiles for and I play them myself. But I would like to share them.

So is it ok to leave out the song and tell people to find it elsewhere?

No, because the gap will vary from MP3 to MP3.

It shouldn't vary much.. and if a person has a version that's very different than the one I used, they could edit the gap themselves.

But yeah, ok, no good then?

In order to play the stepfile we would have to go searching for the mp3 and then probably change the gap and alot of people probably don't know how. It's too inconvinient.
