That pretty much depends on the type of mod you plan to do.
If you just plan to say...change the case, or change a light color...completely legal.

If you use a hard mod chip to burn games, illegal.
If you just tamper the game a bit, I would say legal, unless you use for online play. Still legal, but possible ban.
Abything else, like changing the peripherals around, colour, etc. legal.Comment

Pretty sure after you pay for a product you own the physical object, therefore as long as you don't try to sell it as a product as your own or something then owning a modded PS2 is not illegal.
SNES games unless you own the cartridge (and i think even then...) on the PS2 would also be illegal. Playing burned games, same deal.
It's not like anyone is going to come to your house and arrest you anyway. =/Comment

DMCA made removing some copy-protection stuff in hardware illegal, so it's possible for it to be illegal even though you own the PS2.
But as has already been said, it's irrelevant, as you are guaranteed not to get in any trouble for it as long as you keep it to yourself.4th Official FFR Tournament - Master division champion!

It's known as a secondary offense in the criminal world. No, nobody is going to do a worldwide console check for illegality. But if there was a legitimate reason to come search your house, it would be tacked on.
