Bear in mind also, that given the general policy of Tass in terms of how widespread songs are before they are submitted, that most of the WIPs likely wouldn't be submittable either, considering that they are now publically available to everyone.

what about like ERx8 v2 and nanairo v2 and stuff then. or were the ffr versions before the red fraction releases?

edit: and charts like epidermis, NWE, choprite which are minimal, FFR-compliant edits of already popular stepmania files (well reasonably popular)

In my opinion, just because files were released publicly doesn't mean they shouldn't be released on FFR, they're fun files, why take that away from the FFR players?

Totally agree with this. Not all of us play SM a lot, and if it gets released the FFR players miss out. I don't really see the reason it makes much of a difference. If someone is THAT devoted to it, they could just make an identical stepfile off of the FFR chart. What difference does it make? Publicly released files shouldn't mean they aren't allowed on FFR anymore.

If I recall correctly, BDN took the original SM files for Epidermis, NWE, and Choprite (and some others) and made minor changes to them before submitting them for the FFR queue. They wouldn't have been allowed because they were practically copies, but Tass and the other judges at the time didn't realize that until after they were added to the game. All of those files were additionally labeled with the appropriate SM simfile artist instead of just BDN. BDN was then banned from submitting FFR files, but Tass gave him a second chance later on.

As for ERx8 v2 and Nanairo v2, I'm not exactly sure. Probably something along the lines of Rebirth getting a little special treatment at the time. That or Tass didn't care/didn't know.
