How should I reply?
So I recently asked the label YAWA Recordings to use one of thier songs, and got this reply:
-------------------------------------------------------------------------- Hi (my name)! Hope you're fine! Thanks for your request! Can you tell me a little bit more about your site / the game? Are there any commercials involved? Or do you have any income from this site / the game? Because -as we could see- there are 1.9 million members on your site, and normally we don't give our music to a 1.9 million community for free! Hope you can understand that! Please let me know! Cheers, Jens Ophälders -------------------------------------------------------------------------- I am pretty sure I know how to reply, but what do you think I should include in order to have the best chance of getting permission? Thanks!

a large majority of that 1.85 million figure you see is comprised of spambots. there is actually less than a few thousand active accounts (maybe more, but not even close to the amount that is seen in the banner).
you could tell them that, but in terms of verifying that is the case, i don't know if that would be possible without admin intervention. check out some of the other permission gets to see how people described the game. there is no ad revenue of any type and the site is 100% non-profit. Dear whoever,
The actual figure is slightly less than 1.9 million due to a number of duplicate accounts and such. The actual purpose of our website is purely for fun and entertainment of users. We do not profit in any form whatsoever from usage of our artists' songs. In fact, by being able to use their songs, we are freely promoting the artists' song, giving a win-win situation for all. I hope this gives a better understanding of the situation of our website and games. |

I'd personally just make these points clear...
1) 100% ad free and non-profit 2) There are more like only several thousand active members now at most 3) The use of their songs does not allow anyone to freely attain their music nor do we distribute it. I don't know what the original email sent looked like, but you also want to make it clear that there is no guarantee it will be in the game right away (some artists tend to falsely assume this, so generally stating that someone needs to step a file that needs to be accepted is a good way to keep them informed). Aside from that, best of luck. Looks like a potential to me, since that email just makes them seem a little mal-informed. |

I think it's more important that you correct what appears to be their misconception that they'd be giving their song away to these people. FFR doesn't actually offer a way for them to download the song or do anything besides listen to it, through the site.
Explain that it's a rhythm game like Guitar Hero, that it is entirely non-profit, and that, in fact, exposing their music to that many people is something they should LOVE to do for free, because, since they can't get the music through us, it just increases their exposure and probably nets them new sales. |
